(CABA) Con su discusión paritaria completamente empantanada, el sindicalista Luis Barrionuevo acaba de desempolvar un viejo reclamo gremial: que se vuelva a establecer el “laudo gastronómico”, es decir el pago obligatorio de propinas al personal de bares, restaurantes y hoteles, como ocurre en otros países.
La iniciativa seguramente generará polémica: el gremialista adelantó a Clarín que pretende que el “laudo” sea por el 14, el 16 o el 18% del valor total de la cuenta según la categoría de cada establecimiento (en un 5 estrellas se cobraría el máximo y en una confitería, el mínimo).

El laudo ya existió en la Argentina. Surgió por primera vez en 1946, durante el primer gobierno de Perón. Fue eliminado en 1955, durante la dictadura del teniente general Eduardo Lonardi. El sistema volvió a establecerse en 1973, con el tercer gobierno de Perón. Y fue eliminado otra vez en 1976, por la última dictadura militar.
En las últimas décadas hubo en el Congreso algunos proyectos para volver a imponer el sistema, pero nunca lograron prosperar.
Ahora Barrionuevo amenaza con presentar su proyecto en el congreso que el gremio realizará del martes al jueves de la semana que viene, en Mar del Plata. Es la alternativa que el sindicalista sacó de la galera para tratar de mejorar los salarios de los gastronómicos debido a que la paritaria de la actividad está trabada.

En 2018 los Gastronómicos tuvieron un incremento salarial del 25% (quedó por debajo de la inflación, que cerró en 47,6% según el INDEC). De acuerdo al gremio, existía un compromiso de que recibirían un ajuste del 15% para compensar la pérdida que tuvieron en el último año por culpa de la inflación. “Ahora los empresarios nos dicen que no tienen para pagar ese 15%”, dijo Barrionuevo.

Ante la consulta de Clarín, en la Federación Empresaria Hotelera Gastronómica contestaron que tienen por política «no hacer comentarios sobre negociaciones en curso».
Aparte de esa compensación, el gremio pretende una suba del 35% en 2019, con cláusula de revisión. Pero esas negociaciones vienen aún más trabadas. Según el sindicato, en el Ministerio de Producción y Trabajo les informaron que solo se homologarán acuerdos que no superen el 28%.
Así, quizá para presionar en las negociaciones, el gremio impulsará el regreso del “laudo gastronómico”. En el fondo es una forma de hacer que la suba de los ingresos de los trabajadores del sector recaigan sobre los hombros de los consumidores.

El proyecto en el que trabaja el gremio es que el personal de toda la actividad hotelera y gastronómica tenga un básico -podría ser de dos salarios mínimos- y que aparte reciban el proporcional que les corresponda por el laudo. Traducido, el laudo sería como un pozo al que irían todas las “propinas” y que se repartirían según un índice entre todos los empleados de un establecimiento, desde mozos y cocineros hasta “bacheros”.
Desde lo estrictamente fiscal, el sistema debería favorecer al Estado ya que todas las operaciones deberían hacerse en blanco (para evitarlo debería haber complicidad entre los propietarios de un establecimiento, todos los empleados y los delegados gremiales).
“El Gobierno podría tener un control estricto de toda la fortuna que se gasta en turismo en la Argentina”, defendió Barrionuevo.
El proyecto será oficializado en el congreso Gastronómico de la semana que viene. Después el plan es presentarlo en Diputados, posiblemente a través de Graciela Camaño, esposa de Barrrionuevo. El año pasado la K Fernanda Vallejo presentó un proyecto para establecer la obligatoriedad de las propinas.
