(CABA) La jueza en lo Contencioso Administrativo y Tributario, Romina Tesone hizo lugar este martes a la medida cautelar solicitada por una pareja de mujeres policías de la Ciudad, contra el GCBA, para que se declare la inconstitucionalidad de la medida adoptada por el Ministerio de Justicia y Seguridad porteño, que le denegó a una de ellas la licencia por maternidad de 135 días.
Las mujeres se sometieron a un tratamiento de fertilización asistida y la fecha probable del parto de gemelos es para abril de este año. Contrajeron matrimonio civil en enero pasado.

El reclamo surgió luego que el 9 de noviembre de 2018, B.A.E. solicitó al Jefe de la Comisaría Vecinal 13 A, se le conceda una licencia acorde a su carácter de “madre lactante” o “adoptante”, dado que en el sistema de empleo que rige a la fuerza policial existe un vacío legal con respecto a la figura que contemple una licencia a la “madre no gestante“. Dicho pedido fue rechazado por el gobierno el 7 de diciembre de 2018.
La magistrada señaló que “tal exclusión acredita un supuesto trato discriminatorio”, y advirtió que “la modificación normativa impactaría de modo esencial y mayoritariamente sobre aquellas parejas de mujeres lesbianas o en las que alguno de sus miembros es una persona trans y, por ende, cuenta con una madre no gestante”; además relató que “también afectaría a parejas heterosexuales que recurran a la denominada ‘maternidad subrogada’”.
Según el fallo publicado por el sitio ijudicial, la jueza consideró también que “dada la clara clasificación de categoría sospechosa que contienen las diferenciaciones basadas (o que de hecho impactan) en función de la orientación sexual o cuestión de género de las personas, cabe considerar presuntamente discriminatoria y, por ende, inconstitucional la limitación o restricción de derechos que de tal distinción se deriva”. Agregó que “de acuerdo con las directivas del artículo 10 de la Constitución de la CABA la omisión o insuficiencia de regulación no puede conducir a negar o limitar derechos”.

Tesone indicó que corresponde efectuar “una consideración especial del interés superior del niño, en tanto es claro que el goce de la licencia por maternidad se encuentra regulada también en beneficio de los niños y niñas (más allá de que constituya un derecho laboral)”.
Concluyó que su resolución “propende a efectivizar la igualdad de los miembros de la familia (con independencia de su género) en el cuidado y asistencia de los hijos e hijas y su equidad en las funciones, coadyuvando a desarmar estereotipos sociales en cuanto a la preeminencia de cualquier progenitor/a frente a otro/a”.
