(PBA) Un juez correccional de La Plata resolvió que es inconstitucional el decreto provincial que exige contar con un libre deuda de infracciones como requisito indispensable para poder sacar el registro de conducir.
Juan José Ruiz hizo lugar a un amparo presentado por un motociclista, identificado como Mariano Martinelli, a quien la municipalidad de La Plata no le otorgó la licencia porque tenía una deuda por cinco multas de tránsito impagas, de acuerdo con la agencia Télam.

Voceros judiciales explicaron que el magistrado ordenó a la comuna que prosiga el trámite de la licencia de conducir al motociclista afectado y declaró la inconstitucionalidad del artículo previsto en el decreto 532 del año 2009 que establece la presentación del libre deudas de infracciones para obtener la licencia de conducir.
En su fallo, que refiere únicamente a este caso, el magistrado consideró que el Estado “cuenta con un régimen específico para el cobro de deudas por multas” y citó como ejemplo el juicio de apremio. “Nuestra provincia posee un régimen específico propio para perseguir el cobro de las multas que se imponen a los infractores de tránsito”, explicó según lo publicado por el diario El Día.

“La paralización de un trámite de expedición de licencia, ante la verificación de deudas por infracciones de tránsito, vacía de contenido el juicio de apremio e importa en los hechos transformar por vía reglamentaria una sanción legal de multa e inhabilitación, y esto no puede admitirse como válido, toda vez que cualquier sanción que importe restricción de derechos, sea de orden contravencional o penal, debe tener su origen en la Ley”, aseguró Ruiz.
