Hace unos días un fallo del Juzgado Nacional en lo Criminal y Correccional N° 62 despertó críticas: un delincuente extranjero, que llegó al país hace tres meses, fue detenido tras robar un teléfono celular en Almagro. Sin embargo, a las 48 horas fue liberado después de ser beneficiado con una probation, teniendo que pagar 700 pesos a la víctima.
Hoy, el vicejefe de Gobierno porteño, Diego Santilli, a cargo del Ministerio de Seguridad, se refirió al caso y se mostró indignado por la resolución impuesta al motochorro. Y comentó que tras acordar con el director de Migraciones, Horacio García, libraron una orden de deportación.
“Me da bronca”, comenzó su descargo en radio La Red. “No soy de los que se quejan de los jueces y fiscales. Algunos hacen muy buen laburo pero otros dejan pasar cosas. El primer criterio tiene que ser el del sentido común”, continuó.
El hecho en cuestión comenzó el martes pasado, cuando Jair Steven Jurado Mora, de 25 años, le robó el celular a una joven de 18 que esperaba para cruzar el semáforo en avenida La Plata al 100. El delincuente, que iba a bordo de una moto Bajaj Dominar 400, le arrebató el Iphone 7 y huyó a toda velocidad.
El ladrón fue detenido por efectivos de la Comisaria Vecinal 5A de la Policía de la Ciudad a las pocas cuadras, tras una breve persecución que terminó luego de que hiciese una mala maniobra y chocase contra un auto.
Jurado Mora es de nacionalidad colombiana. Llegó al país hace tres meses y aún no tramitó su residencia. Cuenta con antecedentes: fue condenado en 2011 por “hurto calificado agravado”, en 2016 le abrieron una causa por violencia intrafamiliar y en 2017 lo sentenciaron a 4 años y 6 meses por tráfico de armas en su país. Esta vez, se le inició una causa por “robo en grado de tentativa”.
En un juicio abreviado, la jueza Patricia Susana Guichandut le concedió una “probation”, con la tarea de cumplir cuatro condiciones: regularizar su situación en Migraciones, presentarse todos los meses en el Área de Control y Dirección de Ejecución Penal, no consumir drogas ni alcohol durante un año y resarcir a la víctima del robo con $700. Así, Jurado Mora recuperó la libertad el jueves.
“Nuestro trabajo con Marcelo D’Alessandro (secretario de Seguridad) es poner a los delincuentes a disposición de la Justicia. Desde que recibimos la policía bajaron todos los delitos. El único delito que creció fue el robo en moto. La verdad que este delincuente tenía todo para que la jueza le hiciera un juicio abreviado y lo deportara a Colombia“, consideró Santilli.
Y cuestionó: “Cuando ves lo que ha sido la delincuencia en moto estos años, con la violencia que se registra en cada caso, te das cuenta que no hay delitos pequeños, aunque sea un iPhone 7. Pero encima (la jueza) vio los antecedentes tremendos que tenía en Colombia”.
Por último, Santilli volvió a referirse al uso de las pistolas Taser, que el gobierno nacional adquirió para utilizar en aeropuertos y estaciones de trenes y subtes. “Estamos trabajando para que estén (las pistolas Taser) en áreas controladas de alto tránsito, con protocolo y educación. Empezarán en el subte. Es preferible un arma de baja letalidad que un arma de fuego”, consideró.
