(PBA) El gobierno bonaerense, a cargo de María Eugenia Vidal, presentará este martes ante la Legislatura provincial un proyecto de ley que penaliza e incorpora sanciones contra quienes cometan hechos vandálicos en las escuelas, luego de que se registraran unos 117 incidentes o robos en el mes de marzo.
Las multas o días de arresto alcanzarán también a los padres o tutores cuando el autor de los daños haya sido un menor.

El texto que se presentará incorpora dos artículos al Código de Faltas bonaerense. Según los agregados, se sancionará con 5 a 30 días de cárcel o una multa de entre el 50 y 100 por ciento del sueldo de un oficial subayudante de la Policía bonaerense a las personas que “coloquen, introduzcan o arrojen sustancias insalubres o cosas capaces de producir lesiones” en los colegios públicos y privados, incluyendo sus inmediaciones. También se castigará a quienes manchen o ensucien los inmuebles afectados al servicio educativo.
La propuesta habilita también a que puedan reemplazarse el arresto o la multa por la imposición de 2 a 10 días de trabajos de utilidad pública, en caso de que el contraventor no cuente con condenas previas y que la gravedad lo justifique.
Cuando los autores de las contravenciones sean menores edad, la reforma del Código prevé la imposición de 1 a 5 días de arresto o una multa -del 30 al 60 por ciento de los haberes de un oficial subayudante- a los adultos encargados, en caso que se verifique que la conducta fuera “consecuencia de una falta o negligencia en sus deberes por parte de los padres o tutores”.
Si se trata de una repetición en la contravención, la sanción a los padres se elevará al doble, pudiendo además “imponérseles el cumplimiento de una terapia familiar”, señala el proyecto de ley.

Las cifras del vandalismo
En lo que va del año se produjeron unos 117 hechos de robo y vandalismo en establecimientos educativos bonaerenses. Según datos oficiales, si se incluye el año 2018, hubo en ese período unos 248 incidentes.
En total, reparar esos daños representará para la Provincia de Buenos Aires un costo adicional de $205 millones. El gasto equivale a la construcción de 66 aulas nuevas de jardín, siendo que cada aula de 40m2 tiene un valor de $1,6 millones, informaron desde la cartera educativa.
“El objetivo es proteger al alumno, al docente y a la comunidad educativa en general y asegurar la prestación del servicio educativo“, señalaron fuentes del gobierno bonaerense. Con este tipo de hechos, una escuela no solo queda afectada en la calidad de las condiciones de enseñanza, sino que también en algunos casos “comprometen las clases de los chicos y la seguridad”, completaron.

La iniciativa prevé las formas en que el juez contravencional podrá reemplazar las sanciones por días de utilidad pública. Cada jornada, según dice el proyecto, constará de “tres horas de trabajo” a realizar en establecimientos públicos, como “escuelas, hospitales, u otras instituciones dependientes” del Estado provincial.
Los magistrados son los que deberán definir “los lugares y horarios” fuera de la jornada de actividades laborales o educativas. Además, esta sanción reparatoria “deberá adecuarse a las capacidades físicas y psíquicas” del contraventor, atendiendo sus “habilidades o conocimientos especiales” que pueda aplicar en beneficio de la comunidad.
Los autores de un hecho vandálico también podrán ser sancionados con la obligación de asistir a cursos de enseñanza, capacitaciones, programas diseñados por organismos públicos o privados, o la reparación propia del daño causado. NR
